Request confirmation or a copy from the jail, sheriff, arresting agency, court, or corrections department that created or holds it. An arrest is an accusation, not a conviction. A booking photograph does not prove guilt, and every person is presumed innocent unless proven guilty in court. An absent roster result does not prove that no arrest occurred, while third-party pages may be stale or duplicated.
Kentucky's KRS 61.8746 addresses commercial publication of a booking or official inmate photograph when removal is conditioned on payment or other consideration.
